Unless purchasing registration codes,
shipping/handling charges will apply to all physical goods shipped. We ship
via USPS Insured Priority mail. Payment by our PayPal® shopping cart system
is preferred; however, you may pay with a money order, cashiers or certified
check. No personal checks whatsoever. Payment address can be located

Make sure that your system meets all the
requirements for the particular product(s) that you are purchasing before
you make the purchase. All of our audio products are created on a system
running Windows® XP and are recommended to be used on a IBM compatible PC
running Windows® 98 or higher. Macintosh® computers are not supported! All
of our files are created in .wav (Windows® PCM) or Ogg Vorbis format,
depending upon the product. For software products, please visit the
individual websites for specific requirements for each
software
package.

Terms
Physical goods can only be shipped to US or
Canadian addresses. Sorry, no APO/FPO. Canadian residents are
responsible for any taxes/duties associated with importing this software
product into their country. Software may only be returned to the Developer
according to the policies of EveningStormTM
Enterprises. These policies may change without prior notice. In most cases,
the software may only be returned to the developer in the case of a
non-functional copy, which shall be replaced with an exact copy at no charge
to the licensee. This offer is only valid for 7 days after the receipt of
the software either by mail or electronic download. It is assumed that after
7 days of receipt of the software, that the licensee has had ample time to
test the software. If after 7 days, then please see warranty information
listed in the software license. Opened, completely functional software
cannot be returned. For the purposes of these policies, purchase of a
registration code is considered to be the same as opening the software and
cannot be refunded. This is to deter piracy. Unopened software can be
returned for a refund, minus all shipping/handling/packing/insurance charges
if received in this office within 10 days of Licensee’s receipt of software.
A 25% restocking fee will be deducted, as the other items listed above. The
refund will be sent to the original Licensee at the original address used
during ordering/purchase within 10 business days. Prior to returning any
software, in any condition, a RMA number must be assigned. This can only be
acquired by phone at 704-888-1685 or by email at
eveningstorm@earthlink.net.
Product Licensing
All of our music, effects, etc. CD products are
covered under one blanket license. All of our broadcast material CDs are
covered under a separate license. Please visit the
licensing page and read our terms. Please
note that software is excluded from this blanket as they each have their own
licenses.
Important Note
If you try to play the tracks directly from the CD,
some computers may cause the music to sound like it is skipping or it may not
play correctly. There is nothing wrong with the tracks! To remedy this, simply
download the tracks to your computer system before reviewing/editing. You can
use the Windows®
Explorer or file manager to do this.
Most all EveningStorm sound files are created in either .wav format (Windows®
PCM) .mp3, or Ogg Vorbis (.ogg) format, and are designed to be used on a PC
running Windows® 98 or higher; therefore, it is not recommended to be used on a
Macintosh® computer. Also, please be aware that the Acapellas, Listener Drops,
and Instant Radio Guest CDs are voice track products. In other words, they do
not include music beds in the background. You will need some sort of audio
editing software to blend them into your own recordings for the proper effect.
Some of our CDs may contain an instruction sheet in MS Word® format, while most
will contain .PDF files. Simply browse the CD with your file manager or explorer
and double click the file. Adobe® Acrobat® readers are available free on the
Internet.
Disclaimer
1. EveningStorm Studio/Radio it's agents,
personalities, and any other contacts related directly or indirectly assume
no information for the use or misuse of the information displayed on this
website or produced as a voice track. And will assume no liability for any
loss either business, financial, equipment, or any other medium implied or
not. The customer/client, hereafter referred to as client. No guarantees are
implied that any commercial or advertisement produced by this studio will
have any particular financial effect on the client who ordered the same.
1.a It is the customer's/broadcaster's
responsibility to abide by all FCC regulations when airing any material.
EveningStorm Studio/Radio assumes no liability for the actions of stations
using our material.
2. Under no circumstances will EveningStorm
Studio/Radio produce, air, or take part in any commercial, shout,
announcement or recording that is defamatory, racist, pornographic, vulgar,
or considered unethical according to the moral values of this station.
2.a No returns for any purchase if
products have been opened! This is due to extreme problem with piracy and
copyright violations that run rampant today. We apologize, but we must
remain firm on this section.
Returns will be accepted for DAMAGED or INOPERABLE products only. If a CD-R
is defective upon arrival at the client's address, EveningStorm Studio will
replace it with an exact image of the same CD-R within 7 days of receipt.
EveningStorm Studio will provide one replacement free of charge. It is the
customer's responsibility to immediately inform this office of such a
problem. Failure to notify us within 7 days of receipt will void this
section. All replacement CDs will be tested again before shipping. Any other
requests for replacement CDs after 7 days of receipt of original CD, will be
billed to the customer at the current price plus shipping per CD. Please
make sure that your computer meets the requirements to use our audio files.
3. EveningStorm studio ships all items via USPS Priority mail with
insurance. Insurance is required (included in shipping charges) to protect
both this office and the customer and must be purchased to order from this
office. CD versions or any physical goods can only be shipped to US or
Canadian addresses. Canadian residents are responsible for any taxes/duties
associated with importing this software product into their country.

4. Clients are responsible for downloading any
samples/demos before placing an order. This will give the client a very good
idea of EveningStorm's capabilities. It is recommended that the Client visit
our
DOWNLOAD page prior to ordering.
5. EveningStorm Studio, at this time, is not set up to handle custom music
tracks. If the client is seeking background music/music beds, you are
directed to look at our stock CDs. Please download the demos prior to
purchase.
6. EveningStorm Studio does not rent studio
time! All work is done in house by EveningStorm Studios, which is a private
studio.
7. No royalties or needle drop charges are due
for the usage of the our products. The client has full rights to broadcast
the product or include it in an audio recording as part of a larger project,
or mix it into their own effects. However, the product, as is, cannot be
marketed as a stand alone product for profit. If the client wishes to market
the finished product as a stand alone product, a reproduction license must
be obtained from EveningStorm Studio at the going rate to be determined by
this office. Please inquire.
8. All products will be shipped on CD-R with the
audio tracks being recorded in .wav format (unless otherwise specified) to
be opened on a personal computer with the capabilities to open the same. It
is the client's responsibility to have all audio/computer equipment
necessary to open/edit and use the files on the product CD-R. Products will
not be mastered in standard CD (dat) format due to the nature of some
players inability to open a CD-R disc, unless the client so chooses and
understands the risks. All Windows® operated PCs should be able to open the
.wav format.
9. Payment is accepted by money order, cashiers
checks, certified checks, or credit card through Paypal® only. No personal
or business checks accepted whatsoever. Payment is due upon ordering
products. A payment address is provided below. Please make out all money
